General Terms and Conditions of Sale – Wild Bed SAS
PREAMBLE
These terms and conditions govern the contractual relationship for the sale of individual stays between WILD BED SASU and its customers at campsites managed by WILD BED, in accordance with the provisions of Articles L. 211-1 et seq. of the French Tourism Code.
They regulate all the necessary steps for booking and paying for stays, and govern all subsequent follow-up between the contracting parties.
Any document other than these general terms and conditions of sale, including brochures, advertisements, and catalogs, is for informational purposes only.
Definitions
"WEBSITE" refers to the website https://www.wildbed.fr , published by the company Wild Bed SAS.
"WILD BED" refers to the campsites managed by Wild Bed SASU.
"RENTAL" refers to the rental agreement for pitches or rental units at WILD BED campsites.
"PITCH" refers to a bare pitch where the customer sets up their own camping equipment (tent, caravan, motorhome, rooftop tent, etc.).
"RENTAL UNITS" refers to all types of accommodation (chalets, lodges, mobile homes, tents, caravans, etc.) offered for rent by WILD BED.
"STAYS" refers to a rental with additional services, which are defined in the specific terms and conditions.
"CUSTOMER" refers to any person booking on the website, via the booking center, or directly with a campsite or site whose contact details are listed below, in order to book, order, and/or purchase any services offered by WILD BED.
Entirety
These terms and conditions constitute the entire agreement between the parties. By placing an order, the CLIENT is deemed to have accepted them without reservation, in accordance with Article 1126 of the French Civil Code.
These terms and conditions for renting and booking stays at Wild Bed campsites apply to the exclusion of all other terms and conditions.
They are available on the websites www.wildbed.fr or www.camping-malicorne.fr and shall prevail, where applicable, over any other conflicting version or document.
WILD BED and the CLIENT agree that these terms and conditions exclusively govern their relationship. WILD BED reserves the right to modify these terms and conditions from time to time. They will be applicable as soon as they are published online.
If any rental or booking condition is found to be invalid, it shall be deemed to be governed by the practices in force in the sector of campsite rentals and stays at sites where the company has its registered office in France.
Object
The purpose of these general terms and conditions is to define the rights and obligations of the parties in the context of the rental of camping pitches, rental accommodation or stays offered on its various campsites and sites by WILD BED to the customer, from the website www.wildbed.fr or www.camping-malicorne.fr but also by telephone at its sites, by email, from social media messaging or by mail.
Pre-contractual information
The CLIENT acknowledges having received, prior to booking, these general terms and conditions of sale, rental, and stay, and all the information listed in Article L. 111-1 of the French Consumer Code.
The client has access to all information online or can have the services explained to them by staff on site, by telephone, or electronically.
SERVICES AND PRICES
1) AT WILD BED CAMPSITES:
Camping pitch rentals:
WILD BED provides customers with a bare pitch, accommodating up to 6 people, for their own camping equipment (tent, caravan, or motorhome). Depending on the campsite, WILD BED offers different types of pitches, descriptions of which are available on the website.
The pitch price: This is a flat rate per night for the type of pitch in question. The basic package includes one pitch, one or two people, and one vehicle. Additional people (adults or children) or extra items on the pitch (second vehicle, electrical hook-up, pet, additional tent or marquee, etc.) are subject to an additional daily charge. Rental seasons, rental durations, and pricing periods are listed on the website.
The basic package gives free access to sanitary facilities, reception, swimming pool (where applicable and on opening dates & times), playgrounds and activities offered free or paid.
For safety reasons, the number of people arriving for a stay cannot exceed the capacity of the campsite (maximum 6 people).
Pitches are available from 3pm on the day of arrival and must be vacated before 12pm on the day of departure.
Rental of rental accommodations:
The description, the definition of rental seasons, rental durations and pricing periods are available on the website.
The price of renting accommodation includes the rental of the accommodation, depending on the number of people (according to capacity), the charges (water, gas, electricity), a vehicle, access to reception services, the swimming pool (if applicable and on opening dates & times), the playgrounds, other equipment and the activities offered (free or paid).
For safety reasons, the number of people arriving for a stay cannot exceed the accommodation capacity.
The furnished accommodation must be left clean and in good condition upon departure. All rentals are non-smoking.
Rentals are available from 3pm on the day of arrival and must be vacated before 12pm on the day of departure, except for special offers detailed in our sales brochures and the website www.wildbed.fr or www.camping-malicorne.fr .
Some campsites may, on weekends outside of school holidays, allow either arrival the day before until 10 pm or departure until 5 pm instead of noon (with a surcharge). The customer must specify at the time of booking or upon arrival that they wish to depart at 5 pm and pay the applicable surcharge. The campsite may refuse if the accommodation or pitch is occupied that same evening.
Assignment, subletting: All leases are nominative and may not be assigned or sublet under any circumstances.
CHANGES IN RATES
Prices are dynamic and may change throughout the season. WILD BED cannot be held responsible for any difference in cost between two stays booked for the same period.
Prices shown on the website are in euros, including VAT at the rate in effect on the date the deposit and full payment are received. Any change or modification of the VAT rate, as well as any changes in taxes applicable to the stay, at the time of invoicing, may be reflected in the price of the stay.
TOURIST TAX
The tourist tax, collected on behalf of municipalities or local authorities and payable by the CLIENT, is generally not included in our rates. Its amount is determined per person per day. It is set by the local authority and varies depending on the destination and the age of the individuals, and may be subject to change during the year.
PROMOTIONS and DISCOUNTS
Promotional offers are subject to certain conditions, including availability. Furthermore, price reductions or promotional offers cannot be combined unless otherwise stated.
On these occasions, it is possible that customers may have paid different prices for the same stay. Customers who paid the higher price will not be entitled to a refund of the difference between the price they paid and the promotional price.
A discount will be given to customers making "long" stays on bare pitches: -10% for stays of more than 14 days, -20% for stays of more than 20 days and -30% for stays of more than 30 days.
RESERVATION AND PAYMENT
BOOKING CONDITIONS
The customer can make their reservation online, by phone, email, or mail, based on the presentation of pitches, accommodations, and services offered on the websites www.wildbed.fr or www.camping-malicorne.fr .
All reservations must be accompanied by a payment including:
- A deposit, determined according to the chosen rate and depending on the booking date. This deposit will be between 30% and 100% of the total cost of the stay (rental only or rental with services).
- Any applicable processing/booking fees (see price list) and subscription fees for cancellation/interruption of stay insurance.
Please note that for stays of 1 to 7 nights on a camping pitch, a deposit of 100% of the total cost is required upon arrival.
Regardless of the booking method used, the reservation only becomes effective after Wild Bed sends written confirmation by email (and by post upon request) and after receipt of the deposit, any applicable processing fees, and cancellation insurance premiums.
WEBSITE BOOKING
For online bookings, to validate the order, the customer must accept these terms and conditions by clicking in the designated area and confirm their payment.
Following their booking, the customer will receive an email confirmation containing details of their stay (services included, dates and duration, price, and payment terms).
Electronic signature applicable to online sales
Providing the customer's bank card number online and the final validation of the order will constitute proof of the customer's agreement:
- Payment of sums due for the reservation is due
- Signature and express acceptance of all transactions carried out
In the event of fraudulent use of their bank card, the buyer is advised, as soon as they notice this use, to contact the site where they booked their stay.
PAYMENT TERMS
At Wild Bed campsites:
The full price of the stay is payable:
- 30 days before the start of the stay
- Or immediately for any booking made less than 30 days before the start of the stay
Regulations for stays on bare pitches: the balance of the stay must be paid the day before departure or the day of arrival, depending on the campsite.
Rental Accommodation Terms and Conditions: The balance of the stay must be paid, without reminder from WILD BED, 30 days before the scheduled arrival date for the rental or upon arrival at the campsite when the client has not booked.
If full payment is not received by the agreed date, WILD BED is entitled to consider that the customer has cancelled their reservation and retains the sums already paid.
RIGHT OF WITHDRAWAL
According to Article L. 221-28 12° of the Consumer Code, the right of withdrawal does not apply to accommodation, transport, catering and leisure services provided on a specific date or at specific intervals.
PAYMENT METHODS
At the time of booking, payment of the deposit or the full amount of the stay is made by credit card (Carte Bleue, Visa, and Eurocard/Mastercard are accepted) or via the online payment methods offered on the websites wildbed.fr and www.camping-malicorne.fr (STRIPE: IDEAL, SOFORT, BANCONTACT, GIROPAY; Floa in 4 installments, ANCV holiday vouchers, and bank checks). The transaction is immediately debited from the customer's credit card after verification of the card details. In accordance with Article L.132-2 of the French Monetary and Financial Code, the commitment to pay made using a payment card is irrevocable. By providing their credit card information, the customer authorizes WILD BED to debit their credit card for the amount of the deposit or the full amount of the stay. To this end, the customer confirms that they are the cardholder and that the name on the credit card is indeed their own.
The balance of your stay can be paid by credit card, the online payment methods offered on the website wildbed.fr (STRIPE: IDEAL, SOFORT, BANCONTACT, GIROPAY, bank check), in cash (euros), by holiday vouchers (sent by registered mail with return receipt requested), by bank transfer to the Wild Bed account held at Caisse d'Epargne de Normandie (IBAN FR76 1142 5002 0008 0017 6774 927 BIC CEPAFRPP142), and by check (euros) up to 30 days before arrival at the campsite. Bank checks are not accepted at the campsite.
Special conditions apply when subscribing to the FLOA 3x or 4x payment offer:
"Pay in 3 or 4 installments by credit card with our partner FLOA.
Our financial partner, FLOA, offers payment solutions for your purchases of goods and/or services, in 3 or 4 installments by credit card. These payment solutions are reserved for individuals (adults) residing in France, holding a Visa or MasterCard credit card with an expiry date corresponding to the repayment period. FLOA, RCS Bordeaux 434 130 423, whose registered office is located at Immeuble G7 – 71 Rue Lucien Faure in Bordeaux (33300), is subject to the supervision of the Prudential Control and Resolution Authority (ACPR), 4 Place de Budapest, CS 92459, 75436 PARIS CEDEX 09, and registered with ORIAS under number 07 028 160 (www.orias.fr)."

ALLOCATION OF PLACES / ACCOMMODATIONS
Camping pitches or rental accommodations at WILD BED campsites are allocated on a first-come, first-served basis, regardless of the order in which reservations are received. Management cannot guarantee that a customer will be assigned their preferred pitch or rental accommodation unless they select the "preferred pitch" option when making their reservation. If their chosen pitch or accommodation is available, it will be assigned to them, and they will be required to pay a €10 fee.
However, in the event of force majeure, WILD BED reserves the right to change the allocation of pitches or rental accommodations.
CHANGE OF STAY
A request to modify the services included in the stay may be made up to 10 days before arrival. In this case, WILD BED will do its best to accommodate the request, subject to availability and provided the chosen rate allows for modifications. This modification request is subject to a €30 fee per rental unit and/or pitch. Should WILD BED be obliged to modify the services initially included in the stay, it will make every effort to provide similar services. If it is impossible to provide equivalent services, the client should refer to the "Cancellation and Refund" section.
CANCELLATION AND INTERRUPTION OF STAY INSURANCE
Wild Bed SASU offers optional trip cancellation and interruption insurance distributed by MEETCH. This insurance covers trip cancellations due to illness (hospitalization), serious accident or death, disasters causing significant damage to your home, job loss or changes to your leave by your employer, or being summoned to an exam or court appearance. The specific terms and conditions of this policy are available upon subscription or upon request by email.
When booking online or by phone/mail, customers have the option to purchase the cancellation insurance offered by WILD BED SASU. The cost is a percentage of the total trip price.
CANCELLATION OF STAY
Cancellation due to WILD BED:
The sums paid will be fully refunded.
Cancellation by the customer:
- The customer has taken out MEETCH cancellation insurance: the customer contacts the Meetch service provider directly and is reimbursed for their stay according to the terms and conditions of this contract.
- The customer has not purchased MEETCH cancellation insurance and the following specific conditions apply:Cancellation (total or partial) by the customer: the customer must notify WILD BED either by sending a letter to the following address: WILD BED SAS, Customer Service, 1 rue aux Hervieu, 14790 Fontaine Etoupefour, France; or by sending an email to reclamation@wildbed.fr. The date of receipt of the cancellation notice will determine any applicable cancellation fees. Otherwise, the customer will be liable for payment of all sums due under the contract.
- Rental Accommodation: For any stay cancelled more than 30 days before the arrival date, a cancellation fee of €30 will be retained for each rental unit booked. Between 30 and 15 days before arrival, 50% of the total cost of the stay will be retained, or a fee of €30 if the calculated amount is lower. Between 14 and 7 days before arrival, 75% of the total cost of the stay will be retained, or a fee of €30 if the calculated amount is lower. Less than 7 days before the arrival date, or in case of no-show at the campsite, the full amount of the stay is due and will be retained.
- Camping pitch stays: For any stay cancelled more than 30 days before the arrival date, a cancellation fee of €20 (or the total cost of the stay if it was less than €20) will be charged per pitch. From 30 days before arrival, the deposit will be retained. In case of no-show at the campsite, all sums paid will be retained.
Non-use of additional services: Failure to use the services included in the stay does not entitle you to a refund. Regardless of the cancellation date, booking fees and any insurance premiums are non-refundable.
STAYS / OFFERS / RATES NON-MODIFIABLE AND NON-EXCHANGEABLE “FIRST SERVED”
WILD BED may offer stays and rentals at preferential "first come, first served" rates on specific dates, which are non-modifiable, non-refundable, and non-exchangeable.
The cancellation and modification conditions previously stated do not apply.
Consequently, no refunds will be issued, including refunds for any additional services that may have been booked separately.
DELAYED ARRIVAL, EARLY DEPARTURE
In the absence of a message from the CLIENT acknowledging receipt of the cancellation and specifying that they had to postpone their arrival date, the pitch or accommodation will become available 24 hours after the arrival date stipulated in the rental agreement, and full payment for services remains due.
No discount will be granted for early departures from rental accommodations (see refund options under cancellation insurance).
In the case of early departure from a stay on a bare pitch, we will only retain the deposit for the unused days if the stay has been booked.
SECURITY DEPOSIT
For all stays in rental accommodations, a security deposit of €150 will be required upon arrival at the campsite. This deposit also applies to bicycle rentals. Payment may be made by credit card. The deposit will be fully refunded on the day of departure or within eight days at the latest, after a cleaning inspection and a satisfactory condition of the equipment. Otherwise, the security deposit will be deducted in full or up to the cost of the corresponding service (cleaning, for example). Any damage exceeding the amount of the security deposit will be charged to the client after deduction of the deposit.
HOUSEHOLD
The CLIENT must return their accommodation in a perfectly clean condition. In most of our establishments, they can request that cleaning be carried out by us, subject to a cleaning fee (from €15 to €50: amount may vary depending on the accommodation, the season or the destination – refer to the destination's rates).
LEISURE ACTIVITIES
Any free or paid activity mentioned on our website, in an email or offered on site may, under certain circumstances, be modified or cancelled upon your arrival at the site.
MINERS
Minors unaccompanied by their parents are not accepted at WILD BED campsites.
ANIMALS
Pets are welcome in rental accommodations for an additional fee (which varies depending on the type of accommodation).
Only one pet is allowed per campsite pitch, subject to a daily flat fee. The customer must indicate this when booking or upon arrival.
Pets must be kept on a leash and must not roam freely. They are not permitted in communal areas (sanitary facilities, snack bar, bar, restaurant, entertainment room). Pets are subject to two conditions: – a valid rabies vaccination – identification by tattoo or microchip, certified by a card issued by the French Kennel Club (Société Centrale Canine).
The customer must bring the pet's health record and comply with the site's regulations.
Dangerous or aggressive animals (category 1 and 2 dogs are prohibited) and "exotic pets" are not accepted.
INTERNAL REGULATIONS
To ensure a pleasant stay for all our guests, a set of rules is available at the reception of each of our sites. We ask our guests to read and respect these rules. In the event of a clear breach of these rules, the campsite manager may take disciplinary action, up to and including termination of the contract and requiring the guest's early departure without compensation.
LOSS, THEFT, DAMAGE
WILD BED accepts no responsibility for theft or damage to personal belongings, whether in accommodations, on campsites, or in common areas. WILD BED cannot be held liable for theft or damage to guests' personal belongings except in cases of proven breach of contract by the campsite. It is also important to note that parking is unattended and parking is therefore at the guest's own risk. WILD BED also accepts no responsibility for any incident falling under the guest's civil liability.
PERSONAL DATA
Customer personal data is collected and processed by WILD BED SASU. Some data is essential for managing the customer's booking and will also be used to send them information and/or promotional offers.
In accordance with Article 40 of Law No. 78-17 of January 6, 1978, known as the "Data Protection Act," the customer has the right to access, modify, rectify, and delete their personal data. FORCE MAJEURE
Any circumstances beyond the control of the parties that prevent the normal performance of their obligations shall be considered grounds for exemption from those obligations and shall result in their suspension.
The party invoking the aforementioned circumstances must immediately notify the other party of their occurrence and their cessation.
Force majeure shall be defined as any irresistible event or circumstance external to the parties, unforeseeable, unavoidable, and independent of their will, which cannot be prevented by them despite all reasonable efforts. Specifically, the following shall be considered force majeure or fortuitous events, in addition to those typically recognized by French courts: storms, floods, lightning, earthquakes, fires, telecommunications network outages or difficulties specific to telecommunications networks external to the client, and blockages of transportation or supply routes.
The parties shall consult to examine the impact of the event and agree on the conditions under which the performance of the contract will continue.
If the force majeure event lasts for more than three weeks, the site and accommodation rental contracts will be automatically terminated.
PARTIAL NON-VALIDATION
If one or more provisions of these general terms and conditions are held to be invalid or declared as such pursuant to a law, regulation or final decision of a competent court, the other provisions shall remain in full force and effect.
NON-WAIVER
The failure of either party to enforce any right or provision of these terms and conditions shall not be deemed a waiver of such right or provision.
LANGUAGE OF THE CONTRACT
These general terms and conditions of sale are written in French. If they are translated into one or more foreign languages, only the French text shall prevail in the event of a dispute.
MEDIATION
In the event of a dispute concerning the validity, interpretation, performance, non-performance, modification, or termination of this contract, the CLIENT and WILD BED will endeavor to find an amicable solution. To
this end, the client must send their complaint by registered mail with return receipt requested to WILD BED SASU, 1 rue aux Hervieu, 14790 Fontaine Etoupefour, France, or to the following email address: reclamation@wildbed.fr within one month of the end of their stay.
If the client or WILD BED does not find a satisfactory resolution to a complaint submitted under the aforementioned conditions, the most diligent party will submit the dispute to SAS MEDIATION, a mediation body. For the client's information, recourse to SAS MEDIATION is free of charge, even if the client initiates the process. To learn more about SAS MEDIATION: https://sasmediationsolution-conso.fr . If mediation fails, the client and WILD BED may bring the matter before the competent French court.
APPLICABLE LAW
These terms and conditions are governed by French law, both substantively and procedurally. In the event of a dispute or complaint, the customer should first contact WILD BED to seek an amicable solution.
