General Conditions of Sale – Wild Bed SAS.

PREAMBLE

These conditions govern the contractual relations relating to the sale of individual stays between the company WILD DEB SAS and its customers, in the campsites and sites managed by WILD BED, in accordance with the provisions of articles L. 211-1 and following of the Code. tourism.
They regulate all the steps necessary for the signing of the reservation and the payment of the stays, and regulate all their follow-up between the contracting parties.
Any document other than these general conditions of sale and in particular prospectuses, advertisements, catalogs, has only informative and indicative value.

Definitions

"WEBSITE" means the website http://www.wildbed.fr, published by the company Wild Bed SAS.
“WILD BED” designates the campsites and sites managed by Wild Bed SAS.
"RENTAL" refers to the rental contract for pitches or rentals in WILD BED campsites and sites.
“RENTALS” refers to all types of accommodation (chalets, lodges, mobile homes, tents, caravans, etc.) offered for rental by WILD BED.
"STAYS" means a rental with additional services which are defined in the special conditions.
"CUSTOMER" means any person booking on the website, via the reservation center or directly with a campsite or a site whose contact details are given below in order to book, order and/or purchase any services offered by WILD BED

Entirety

These general conditions express the entirety of the obligations of the parties.
In this sense, the CUSTOMER is deemed to accept them without reservation and in accordance with the provisions of article 1126 of the Civil Code. These general conditions of rental and reservation of stays in a campsite or a Wild Bed site apply to the exclusion of all other conditions.
They are accessible on the website www.wildbed.fr and will prevail, where applicable, over any other version or any other contradictory document.
WILD BED and the CLIENT agree that these general conditions exclusively govern their relationship.
WILD BED reserves the right to modify its general conditions from time to time. They will be applicable as soon as they are put online. If a condition of rental or reservation of stay were to be lacking, it would be considered to be governed by the practices in force in the sector of the rental of campsites and stays in sites where the company has its headquarters in France.

Object

The purpose of these general conditions is to define the rights and obligations of the parties in connection with the rental of camping pitches, rental accommodation or stays offered on its various campsites and sites by WILD BED to the customer, from from the website www.wildbed.fr but also by telephone from its sites, by email, from social network messaging or by post.
Pre-contractual information The CUSTOMER acknowledges having been informed, prior to his reservation, of these general conditions of sale, rental and stays, and of all the information
listed in article L. 111-1 of the consumer code.
The customer has all the information online or can have the services explained to him by the staff on site, by telephone or electronically.

SERVICES AND PRICES

1) AT WILD BED CAMPSITES:

Rental of camping pitches:

WILD BED provides the client with a bare pitch, which can accommodate up to 6 people, for their tent, caravan or motorhome.
Depending on the campsites, WILD BED offers different types of pitches, the descriptions of which are presented on the website.
The price of the pitch: This is a fixed price per night of occupancy for the type of pitch concerned.
The basic package includes an installation, 1 or 2 people and a vehicle. The “comfort” package also includes an electrical connection. Additional people (adults or children) or additional items present on the pitch (second vehicle, animal, additional tent or barnum, etc.) are subject to an additional daily cost. The basic package gives free access to sanitary and reception facilities, to the swimming pool (if applicable and to the dates and opening hours), to the playgrounds and to the activities offered free of charge or for a fee.
For security reasons, the number of people arriving for a stay may not exceed the capacity of the camping pitch.
Pitches are available from 2 p.m. on the day of arrival and must be vacated before 12 p.m. on the day of departure.

Rental of rental accommodation:

The description, the definition of rental seasons, rental durations and tariff periods appear on the website.
The price of renting accommodation includes the rental of accommodation, depending on the number of people (depending on capacity), charges (water, gas, electricity), a vehicle, access to reception services , the swimming pool (if applicable and on the dates & opening hours), the playgrounds, the other equipment and the activities offered (free or paid).
For security reasons, the number of people arriving for the stay cannot exceed the capacity of the accommodation.

The accommodation, fully equipped, must be restored and clean upon departure.
The rentals are all non-smoking. Rentals are available from 4 p.m. on the day of arrival and must be vacated before 11 a.m. on the day of departure, except for occasional promotions detailed in our sales brochures and the website www.wildbed.fr.
Some campsites may on weekends, outside school holidays, accept a departure in the afternoon instead of 11am. However, the CUSTOMER must specify when booking or upon arrival that he wishes to leave at 4 p.m. The campsite may refuse if the accommodation is occupied the same evening.

Assignment, subletting: All rentals are nominative and cannot under any circumstances be assigned or sublet.

2) AT WILD BED SITES:

Stay in rental accommodation:

If the CLIENT chooses to stay in one of our accommodations, the price of the stay includes the rental of the accommodation, depending on the number of people (depending on capacity), the charges (water, gas, electricity), a vehicle, access to reception services, to the swimming pool (if applicable and at opening dates & times), and to free or paid activities.
This package includes the provision of sheets and towels, and access to site equipment.

Stay on a camping pitch:

If the CUSTOMER chooses to stay with his own equipment on a camping pitch, the price of the stay is calculated on a fixed basis for 2 people which includes the provision of a WILD BED pitch for 2 people and a vehicle, the access to site facilities, activities and services determined in the special conditions. Additional people (adults or children) or additional items present on the pitch (second vehicle, animal, additional tent, etc.) are subject to an additional daily cost.

Provision of accommodation / pitches:

Accommodation and pitches are available from 4 p.m. on the day of arrival and must be vacated before 10 a.m. on the day of departure.
On weekends, excluding school holidays, insofar as the accommodation is not reserved the same evening, the CUSTOMER may have access to his rental/site until 4 p.m. He will simply have to make the request at the time of his reservation. In the event of early arrival and depending on availability on the site, everything will be done to reduce the CLIENT's waiting time.

CHANGES IN RATES

Rates are dynamic and may change as the season progresses.
WILD BED can in no way be held responsible for a difference in cost between two stays booked for the same period. The prices indicated on the site are in euros, including VAT at the rate in force at the time of receipt of the deposit and the full price. Any change or modification of the rate as well as any change in the taxes applicable to the stay, on the date of invoicing, may be passed on to the price of the stay.

TOURIST TAX

The tourist tax collected on behalf of the municipalities or communities and to be paid by the CLIENT, is not included in our prices. Its amount determined per person and per day. It is decided by the community and is variable according to the destinations, the ages of the people and could be modified during the year.

PROMOTIONS

Promotional offers are subject to certain conditions and in particular to availability.
In addition, price reductions or promotional operations cannot be combined with each other unless otherwise stated. On these occasions, it is possible that for the same stay, customers have paid different prices.
Customers who have paid the highest price will in no case be entitled to a refund of the difference between the price they paid and the promotional price.

BOOKING AND PAYMENT – BOOKING CONDITIONS

The customer has the possibility of making his reservation online, by telephone, by email or by post, from the presentation of the pitches, accommodation and services offered on the site www.wildbed.fr.

All reservations must be accompanied by a payment including:
– A deposit, determined according to the rate chosen and depending on the reservation date.
This deposit will be between 30% and 100% of the total amount of the stay (rental only or rental with services).
– Any administrative/reservation costs (see price list) and subscription to cancellation-interruption of stay insurance.
Note that for stays of 1 and 2 nights on a camping pitch, the deposit requested is 100% of the amount of the stay.
Regardless of the channel chosen, the reservation becomes effective only after the written confirmation of the reservation has been sent by Wild Bed by email (and on request, by post) and, after receipt of the amount due of the deposit, and any costs file and subscription to the cancellation insurance.

RESERVATION ON WEBSITE

Concerning online reservations, for the order to be validated, the customer must accept, by clicking in the indicated place, these general conditions and validate his payment.
Following his reservation, the customer will receive a confirmation by e-mail containing the details of his stay (content of services, dates and duration, price and terms of payment).
Electronic signature applicable to online sales
The online provision of the customer's credit card number and the final validation of the order will constitute proof of the customer's agreement:
– payment of the sums due for the reservation,
– signature and acceptance express of all the operations carried out.
In the event of fraudulent use of his bank card, the buyer is invited, as soon as this use is observed, to contact the site where he has reserved his stay.

TERMS OF PAYMENT

In the Wild Bed Sites:
The full price of the stay is due:
– 30 days before the start of the stay
– Or immediately for any reservation made less than 30 days before the start of the stay

In Wild Bed Campsites:
Payment for stays on bare pitches: the balance of the stay must be paid the day before departure or the day of arrival, depending on the campsites.
Rental stay payment: The balance of the stay must be paid, without reminder from WILD BED, 30 days before the scheduled arrival date for the rental or on arrival at the campsite when the customer has not reserved .
In the absence of full payment on the agreed date, WILD BED is entitled to consider that the customer has canceled his reservation and retains the sums already paid.

RIGHT TO RETRACT

According to Article L. 221-28 12° of the Consumer Code, the right of withdrawal does not apply to accommodation, transport, catering and leisure services provided on a date or according to a determined frequency.

PAYMENT METHODS

When booking, payment of the deposit or the entire stay is made by credit card (cards accepted are those of the Carte Bleue, Visa, Eurocard/Mastercard networks).
The transaction is immediately debited from the customer's bank card after verification of the latter's data. In accordance with article L.132-2 of the Monetary and Financial Code, the commitment to pay given to the CGV Wild Bed SAS – SIRET 849 920 046 00018 RCS Caen – update June 10, 2019. Page 2 by means of a card of payment is irrevocable.
By communicating the information relating to his credit card, the customer authorizes WILD BED to debit his credit card for the amount of the deposit or the entire stay. To this end, the customer confirms that he is the holder of the bank card to be debited and that the name appearing on his bank card is indeed his. Payment of the balance of the stay can be made by credit card, in cash in euros, by transfer to the Wild Bed bank account held at the Caisse d'Epargne de Normandie (IBAN FR76 1142 5002 0008 0017 6774 927 BIC CEPAFRPP142) and by
check in euros up to 30 days before arrival at the campsite. Checks are not accepted on the campsite.

ALLOCATION OF LOCATIONS / ACCOMMODATION

The allocation of places (camping or rental) whether in a campsite or a WILD BED site, is carried out without distinction in the order of registration of reservations.
The Management cannot under any circumstances guarantee that the pitch or rental requested by the CLIENT will be assigned to him unless the latter, when booking, chooses the “preferred pitch” option. If the accommodation/site of his choice is available, it will be assigned to him and, in return, he will have to pay a flat rate of €10. Nevertheless, in the event of force majeure, WILD BED reserves the right to modify the allocation of the pitch or the rental.

CHANGE OF STAY

A request for modification of services provided for the stay by the customer may be made up to 10 days before arrival. In this case, WILD BED will endeavor to make every effort to comply with this request according to availability, if the rate chosen accepts the modifications. This request for modification is subject to the collection of a flat rate of €30 for each rental and/or each pitch. In the event that WILD BED is obliged to modify the services initially planned for the stay, it will make every effort to provide similar services. If it is impossible to provide the equivalent service, WILD BED will reimburse the CLIENT.

CANCELLATION AND INTERRUPTION OF STAY INSURANCE

Wild Bed SAS does not offer cancellation and interruption of stay insurance, but the CLIENT is invited to take out
personal insurance when booking.

CANCELLATION OF STAY

Cancellation by WILD BED: the sums paid will be refunded and as compensation WILD BED will offer customers an equivalent stay (except in cases of force majeure).
Cancellation (total or partial) by the customer: the latter must notify WILD BED either by sending a letter to the following address: WILD BED SAS, Customer Service, 1 rue aux Hervieu, 14790 Fontaine Etoupefour;
or by sending an email to reclamation@wildbed.fr. The date of receipt of the cancellation will determine any cancellation fees. Failing this, the customer will be required to pay the sums due under the contract. Whatever the date of cancellation selected, the administrative costs and any insurance taken out are non-refundable.

Cancellation scale for a stay in a Wild Bed Site:

For any stay canceled more than 30 days before the arrival date, a cancellation fee of €40 (or the total amount of the stay if it was less than €50), for each rental and/or each pitch, the booking fees and any cancellation insurance subscription amount will be retained. From 30 days before arrival or in the event of no-show at the site, the total amount of the stay is due and retained.

Non-consumption of additional services:

The fact of not having used the services provided for the stay, cannot give rise to reimbursement.

STAYS / OFFERS / RATES NON MODIFIABLE AND NON EXCHANGEABLE “1st SERVED”

WILD BED can offer stays and rentals at preferential “1ST served” rates on specific dates which are non-modifiable, non-refundable, non-exchangeable.
The cancellation and modification conditions provided for above are not applicable.
Consequently, no reimbursement can be made, including the reimbursement of ancillary services which would have been reserved in addition.

DELAYED ARRIVAL, EARLY DEPARTURE

In the absence of a message from the CUSTOMER acknowledging receipt, specifying that he had to postpone the date of his arrival, the pitch or accommodation becomes available 24 hours after the date of arrival provided for in the rental contract
. , and full payment of benefits remains required.
No reduction will be granted in the case of an early departure in rental (see possibilities of reimbursement within the framework of the cancellation insurance).
In the case of an early departure during a stay on a bare pitch, we will only keep the deposit for the days not taken if the stay has been reserved.

SECURITY DEPOSIT

For any stay in rental accommodation, a security deposit of €50 will be requested at the latest on arrival at the campsite, this security deposit is also valid for bike rental.
Payment may be requested by credit card. The latter will be returned in full on the day of departure or at the latest within eight days, after a cleaning check and satisfactory condition of the equipment. Otherwise, the security deposit will be taken in full. Damage greater than the amount paid as a security deposit will be borne by the customer after charging the security deposit.

HOUSEHOLD

The CUSTOMER must return his accommodation in a perfect state of cleanliness. In the majority of our establishments, he can request that the cleaning be carried out by us, for a cleaning fee from €35 (amount which may vary according to the season or the destination – refer to the prices of the destination).

HOBBIES

Any free or paid activity mentioned on our website, in an email or offered on site may, in certain circumstances, be modified or canceled upon your arrival on the site.

MINORS

Minors unaccompanied by their parents are not accepted on WILD BED sites.

ANIMALS

Only one pet is allowed per accommodation or pitch, subject to the payment of a fixed sum per day.
The CUSTOMER must indicate this when booking or upon arrival on site. Pets cannot move freely and must be kept on a leash.
They are not allowed in collective premises (toilets, snack bar, bar, restaurant, entertainment room). Their reception meets two conditions: – valid rabies vaccination – identification by tattoo or chip attested by a card published by the Société Centrale Canine. The customer must bring the animal's health record and comply with the internal regulations of each site.
Dangerous or aggressive animals (dogs of 1st and 2nd category prohibited) as well as "new pets" are not accepted.

INTERNAL RULES

In order to facilitate the course of the stay of all our customers, internal regulations are available at the reception of each of our sites. We thank our customers for reading and respecting it. In the event of obvious non-compliance with these regulations, the Site Director may impose penalties which may go as far as termination of the contract.

LOSS, THEFT, DAMAGE

WILD BED declines all responsibility in the event of theft and damage to personal items both in the accommodation and in the common premises.
WILD BED cannot be held responsible in the event of theft or damage to customers' personal items, except in the event of a proven breach by the campsite of its contractual obligations. It is also recalled that the car parks are not guarded and that parking is therefore at the risk and peril of the customer. WILD BED also declines all responsibility in the event of an incident relating to the CLIENT's civil liability.

PERSONAL DATA

Customers' personal data is collected and processed by WILD BED SAS.
Some data is essential to manage the reservation of the CLIENT's stay and will also be used to send him information and/or promotional offers. In accordance with article 40 of law n ° 78-17 of January 6, 1978 known as the “Informatique et Libertés” law, the CLIENT has a right to access, modify, rectify and delete personal data concerning you. .

FORCE MAJOR

All circumstances beyond the control of the parties preventing the execution under normal conditions of their obligations are considered as causes for exemption from the obligations of the parties and lead to their suspension.
The party who invokes the circumstances referred to above must immediately notify the other party of their occurrence, as well as of their disappearance.
Will be considered as cases of force majeure all irresistible facts or circumstances, external to the parties, unforeseeable, inevitable, beyond the control of the parties and which cannot be prevented by the latter, despite all reasonably possible efforts.
Expressly, are considered as cases of force majeure or fortuitous events, in addition to those usually retained by the jurisprudence of French courts and tribunals: storms, floods, lightning, earthquakes, fires, shutdown of telecommunications networks or difficulties specific to telecommunications networks external to customers, blocking of means of transport or supplies. The parties will come together to examine the impact of the event and agree on the conditions under which the performance of the contract will be continued.
If the case of force majeure lasts longer than three weeks, the location and accommodation rental contracts will be automatically terminated.

NON-VALIDATION PARTIAL

If one or more stipulations of these general conditions are held to be invalid or declared as such pursuant to a law, a regulation or following a final decision of a competent jurisdiction, the other stipulations will retain their full force. and their scope.

NO WAIVER

The fact for one of the parties not to take advantage of a breach by the other party of any of the obligations referred to in these general conditions cannot be interpreted for the future as a waiver of the obligation. in question.

CONTRACT LANGUAGE

These general conditions of sale are written in French. In the event that they are translated into one or more foreign languages, only the French text shall prevail in the event of a dispute.

MEDIATION

In the event of a dispute that may arise regarding the validity, interpretation, performance or non-performance, modification or termination of the contract, the CLIENT and WILD BED will endeavor to find an amicable solution.
To this end, the customer will send his complaint by registered mail with acknowledgment of receipt to WILD BED SAS 1 rue aux Hervieu 14790 Fontaine Etoupefour, France or to the following address: reclamation@wildbed.fr within one month of
the stay.
In the absence of a response considered satisfactory, by the client or by WILD BED, to a complaint formulated under the conditions mentioned above, the most diligent party will submit the dispute to MEDICYS, a mediation body initiated by the National Chamber of Judicial Officers . For the perfect information of the customer, it is indicated to him that the recourse to MEDICYS is a free procedure for him, even if he would be at the initiative of his referral. APPLICABLE LAW

These general conditions are subject to the application of French law. This is the case for the rules of substance as well as for the rules of form. In the event of a dispute or complaint, the customer will first contact WILD BED to obtain an amicable solution.
